Suppression overruled in assault with firearm case

LIMA — A suppression motion was overruled Monday in the Allen County Common Pleas Court for a Lima man facing charges of felonious assault and discharging a firearm near a prohibited premises.

The motion was made by David Johnson’s attorney, Assistant Public Defender Stephen Chamberlain, because he said Johnson was not properly advised of his Miranda rights while in custody.

Judge Terri Kohlrieser reviewed a recording of Johnson’s interview at the Lima Police Department with Det. Steve Stechschulte on June 9 and determined Stechschulte properly advised Johnson of his rights before speaking with him.

The next scheduled event in the case is a final pretrial on Oct. 31.

Johnson, 42, was previously offered a plea deal for two of the six felonious assault charges he’s facing with firearm and weapon forfeiture specifications. The deal expired Sept. 30.

A previous news release from Lima Police Det. Steven Stechschulte said in June, Lima police officers were dispatched to an ongoing dispute between two families, and Johnson fired 13 shots at the crowd. Several shots hit a car parked in a travel lane, and two shots struck pedestrians who were there because of the fight. The pedestrians had non-life-threatening injuries.

In the Lima Municipal Court, Mark Collins, 27, of Lima, pleaded guilty at the beginning of the month to telephone harassment and menacing and was fined $100. Johnson’s wife said these charges came after Collins threatened her family and were related to the physical dispute.
