Suppression overruled in assault case

LIMA — A suppression motion was overruled Monday in the Allen County Common Pleas Court for a Lima man facing three counts of felonious assault.

The motion was made by James Martin’s attorney, Assistant Public Defender Stephen Chamberlain, because he said Martin was not properly advised of his Miranda rights while in custody.

Judge Terri Kohlrieser reviewed three recordings, and in each she determined Lima Police Det. Steve Stechschulte properly advised Martin of his Miranda rights. She reviewed one video from a police officer’s body camera and two videos from interviews while Martin, 26, was being questioned by Stechschulte.

In a response to the motion, Assistant Prosecutor Colleen Limerick wrote Martin “has training and experience as a corrections officer” and has a prior conviction for trespassing.

The next scheduled event is a jury trial, set to begin Nov. 6.

The charges stem from an incident that occurred around 12:45 a.m. June 12. Court documents include a narrative from police that said Martin allegedly shot at a vehicle on East Market Street after he and his girlfriend had an argument. Martin’s infant son was in the vehicle.

Three bullets struck the rear passenger side of the car, and one bullet went into the rear bumper. No one was injured. Martin allegedly admitted to shooting but said he was aiming at the ground.
