LIMA — A Lima man was sentenced to a minimum of six years in prison Thursday in the Allen County Common Pleas Court for three charges of drug possession after a jury found him guilty in August.
A total of $12,500 in fines was also imposed, but Judge Terri Kohlrieser waived the fines due to Marcus McLellan’s inability to pay them.
Allen County Assistant Prosecutor Cecily Stewart said the state’s recommendation for McLellan’s sentence was a total of 9.5 years in prison and she cited McLellan’s juvenile and adult record — including drug possession and trafficking and felonious assault — and history of noncompliance with community control sanctions — like drug court, reentry court and probation.
In the jury trial last month, Assistant Prosecutor Colleen Limerick said McLellan, 44, was found driving with 1.11 grams of methamphetamine in a tray, 6.97 grams of cocaine in his pocket, a black bag on the floorboard of the truck with 17.47 grams of methamphetamine in 21 portioned bags, 5.24 grams of cocaine and 2.75 grams of a mixture of xylazine, cocaine, heroin and fentanyl.
Lima Police Officer Garrett Weekly was off duty when he noticed McLellan and Trevor King in a parking lot in a truck appearing to be tweaking and nodding off and called it into dispatch. In an interview with Investigator Aaron Montgomery, McLellan confirmed he had a tray with drugs and paraphernalia in his lap and he was high.
