Lima man deemed temporarily incompetent for trial

LIMA — Judge Terri Kohlrieser determined Wednesday a Lima man is currently incompetent to stand trial but could be competent within a year.

Kohlrieser reviewed a report from the Forensic Psychiatry Center for Western Ohio for Bryan Booth.

“Because of the defendant’s present mental illness, the defendant is not capable of understanding the nature and objective of the proceedings against him and is not capable of assisting in his own defense and that defendant is, therefore, incompetent to stand trial, but restorable,” she said.

Booth will be transported to the Northwest Ohio Behavioral Healthcare Hospital in Toledo.

Booth, 56, pleaded not guilty due to insanity earlier this month. His lawyers filed a motion suggesting he is not competent to stand trial for the charge of felonious assault, a second-degree felony.

According to court documents, the assault occurred May 25 and was labeled as a domestic dispute. Officers found Booth outside bleeding from the right side of his face. He told officers he struck the victim in the head with a baton and said, “He’s not going to be anywhere, I hurt him, I killed him just about.”

The victim was transported to Mercy Health-St. Rita’s Medical Center and needed 11 staples and two stitches in his head.
