Greenville man pleads guilty to amended burglary, sex charges

WAPAKONETA — A Greenville man pleaded guilty Monday in Auglaize County Common Pleas Court to reduced charges of burglary and attempted gross sexual imposition, a third and fifth-degree felony.

Robert Nicely, 32, was indicted on aggravated burglary, a first-degree felony; burglary, a second-degree felony; two counts of gross sexual imposition, fourth-degree felonies; two counts of sexual imposition, third-degree misdemeanors; and one count of the unauthorized use of property, a fourth-degree misdemeanor. All of these charges were dismissed with Nicely’s guilty plea.

For the counts Nicely pleaded guilty to, he could be sentenced to a maximum four-year prison sentence and could receive a maximum fine of $12,500. He is also a tier I sex offender and has to give law enforcement his information every year for 15 years.

A pre-sentence investigation and a victim impact statement were ordered before sentencing. Judge Frederick Pepple ordered Nicely’s bond be revoked until sentencing and he was taken into custody.

The incident that led to the charges was discussed at the hearing Monday. On April 24, a 21-year-old woman called the police to report there was a man she didn’t know in her apartment who touched her while she was asleep. Nicely touched her private area over the blankets and told her not to scream and asked her if she wanted to smoke marijuana with him.

Police discovered Nicely lived in the apartment across from the woman and had a key to her apartment which was found during a search. The woman also identified Nicely in a police lineup.

In court, Nicely said he didn’t know the woman and didn’t know he had a copy of her apartment key. He said he found the key outside of her door and went in to ask if she wanted to smoke marijuana. The landlord of the apartments was Nicely’s employer, and Nicely helped the landlord remodel the apartments.
