Lima man waives speedy trial on rape charges

LIMA — A Lima man charged with rape and gross sexual imposition waived his right to a speedy trial Monday to allow his attorney more time to prepare a defense.

Anthony Elliott, 74, appeared Monday morning in Allen County Common Pleas Court. Judge Terri Kohlrieser conferred with both Elliott and his attorney, Anthony Van Noy about the implications of waiving Elliott’s right to a speedy trial before Elliott signed the required waiver.

Elliott was indicted in December on two first-degree felony counts of rape, a third-degree felony charge of gross sexual imposition and a misdemeanor charge of public indecency. Elliott pled not guilty in late December.

The charges center around an alleged victim under 10 years of age, which would mean the maximum potential sentence for Elliott, if convicted, would be life in prison. The acts leading to the charges of rape allegedly took place from November 2014 to November 2016, while the gross sexual imposition charges stem from acts that allegedly occurred between November 2018 and Nov. 2, 2020.

A final pretrial hearing is scheduled for 9:30 a.m. May 10 in Judge Kohlrieser’s courtroom with a jury trial scheduled to begin at 8:45 a.m. June 10.
