Man files wrongful death lawsuit over traffic crash

LIMA — A man is suing an insurance company over his father’s death and his own injuries in connection with a traffic crash a year ago.

Kyle Conaway filed the wrongful death and personal injury lawsuit in Allen County Common Pleas Court, seeking more than $25,000 in damages, legal fees and a judgment against The Cincinnati Insurance Co. of Cincinnati.

Conaway is the administrator for the estate of his father, Darrin L. Conaway, who was 50. Lee’s Hydraulic & Pneumatic Service of Lima was issued the insurance policy.

The crash occurred Jan. 8, 2014, when the Conaways were passengers in a vehicle operated by Mark Schlachter, 27, of Ada. The vehicle left the road and collided with a telephone pole, the lawsuit said.

The Ohio State Highway Patrol reported an icy roadway led to the crash. Both Conaways were ejected from the minivan in the crash. Schlachter was driving west on County Road 20 near Kenton just after 8 a.m. when he lost control on the slick road, the patrol reported.

None of the occupants in the minivan were wearing seat belts, the patrol reported. Schlachter was not injured.

The lawsuit said both Conaways suffered pain from the crash and Kyle Conaway has permanent injuries, medical bills and lost wages. There also are funeral expenses for Darrin Conaway.

The action also accuses Schlachter as being negligent but he is not a named party in the lawsuit and neither is Lee’s Hydraulic.
