LIMA — A woman is suing Black and White Cab over an accident in which she said the cab driver fell asleep behind the wheel and ran into her car causing serious injuries.
Jacqueline Lee, of Lima, filed the lawsuit this month in Allen County Common Pleas Court seeking more than $25,000 in damages. Also named as defendants were Scott Hunt, the cab driver, and Victoria Specialty Insurance of Cleveland, which insures Black and White.
The accident happened Nov. 17, 2013, when Lee was stopped at a red light in the eastbound lane of state Route 309 at the intersection of Cole Street. Hunt was driving a cab east when “he admittedly fell asleep at the wheel and forcefully struck the rear of plaintiff’s vehicle,” according to the lawsuit.
The action accuses Hunt of negligently operating the taxicab while fatigued. It said he was acting within the scope of his employment in a cab owned by Black and White, according to the lawsuit.
The lawsuit accuses Black and White of failing to properly supervise and train Hunt.
Lee said she has permanent injuries to her back, neck, chest and shoulder. She said she has pain and suffers physically and emotionally. She said it has limited her ability to perform usual functions, according to the lawsuit.
She said her bills include medical expenses of $13,036 and lost wages, according to the lawsuit.
A representative for the cab company could not be reached for comment Tuesday.
