WAPAKONETA — A man charged in a murder more than 30 years ago wants every statement he made to police tossed.
The suppression hearing for Tracy Mabry was scheduled for Monday in Auglaize County Common Pleas Court but was postponed until Jan. 26. Attorneys said there were six to eight hours of statements captured on audio or video that were at issue.
Mabry’s legal team is trying to get the statements tossed as evidence.
Visiting Judge Reginald Routson scheduled two days for the hearing. Mabry’s trial was rescheduled to begin March 9.
Mabry, 52, of Celina, is charged with aggravated murder in the death of Marcellus Reineke. Reineke was beaten and stabbed to death inside his St. Marys apartment at 229 S. West St., on Oct. 13, 1981. Relatives found his body a few days later after they were unable to reach him and went to check on him.
Another man, Paul Hoover, 53, was sentenced to seven to 25 years in prison on the charge of involuntary manslaughter for his role in the crime.
