Lawsuit settled between Celina, family of man shot and killed by officer

CELINA — The family of a man who had an unloaded gun when he was shot and killed by police has settled their lawsuit against a western Ohio city and a former officer.

The settlement with the city of Celina calls for a settlement of $800,000. The deal also says the city and former officer admit no liability.

Authorities say 39-year-old Robert Hensley, of St. Marys, was fatally shot in April 2013 after getting calls about a man waving a gun but not aiming at anyone.

Police say Hensley was shot after turning toward the officer with the gun in his hands. Investigators later found the gun wasn’t loaded.

A grand jury eventually decided against bringing charges against the officer. The city’s mayor said the officer did nothing wrong.
