Jury trial begins for Lima man accused of drug possession

LIMA — A jury trial began Monday in Allen County Common Pleas Court for a Lima man accused of possession of multiple drugs.

In her opening statement, Allen County Assistant Prosecutor Colleen Limerick said Marcus McLellan was found driving with 1.11 grams of methamphetamine in a tray; 17.47 grams of methamphetamine in 21 portioned bags; 5.24 grams of cocaine; 2.75 grams of a mixture of xylazine, cocaine, heroin and fentanyl; and 6.97 grams of cocaine in his pocket.

Three Lima police officers testified on day one of the jury trial, Garrett Weekly, Logan Patton and Jacob Mortimer.

Weekly was off duty on July 20, 2023, near Cable Road when he noticed McLellan and Trevor King in a parking lot in a truck, appearing to be tweaking and nodding off. Weekly called it into dispatch, and on-duty officer Patton made contact with the truck with his K-9 and found McLellan in the driver’s seat with a tray, a glass pipe and cocaine.

Patton also noticed a black bag at McLellan’s feet on the truck’s floorboard. Mortimer also responded, and Patton and Mortimer’s body cameras captured the tray and the bag with drugs and drug paraphernalia inside. Patton’s K-9 alerted them to narcotics near the driver’s side door before they searched the bag.

McLellan was indicted on a second-degree felony of aggravated possession of drugs; a third-degree felony of possession of cocaine; and a fourth-degree felony of possession of heroin for having between five and 50 times the bulk amount of methamphetamine; between 10 and 20 grams of cocaine; and between one and five grams of heroin.
