Court sets trial date for Elida bleacher lawsuit

ELIDA — A jury trial for a Kenton woman suing the Elida school board is scheduled to begin next September.

Attorneys for the school board and plaintiff Marci Kieffer met on June 11 to set trial and mediation dates.

Kieffer alleges a set of “poorly maintained” wooden bleachers slid out from under her as she was leaving a basketball game at Elida Middle School in December 2022, according to the lawsuit, which she filed in Allen County Common Pleas Court in January.

The lawsuit alleges Kieffer incurred more than $32,000 in medical bills from “severe and permanent injuries.”

She’s asking for a jury trial and $25,000 judgment plus interest and attorney fees to cover those bills.

Attorneys for the school board denied wrongdoing in a written response to the court, which claims in part that Kieffer “failed to look” and that “her breach of this affirmative duty” caused her injuries.

Magistrate Anthony DiPietro will oversee a mediation hearing at 10 a.m. March 6, 2025.

If the two parties do not reach an agreement during mediation or a final pre-trial hearing slated for next August, the case will proceed to trial on Sept. 16, 2025.
