Former Allen East band director waives right to jury trial

KENTON — Dennis Dellifield, the former Allen East band director who is facing numerous charges revolving around his alleged attempted use of a minor in nudity-oriented material, has waived his right to a jury trial and will now be tried by Hardin County Common Pleas Court Judge Scott Barrett. Dellifield appeared in court Thursday for a pre-trial hearing, at which time he agreed to a trial to the court.

Three days have been set aside for the trial that is scheduled to begin Jan. 23. A final pre-trial hearing will be held at 3 p.m. Jan. 16, according to online court records.

Dellifield, 70, was indicted July 26 on four counts of attempted pandering obscenity involving a minor, third-degree felonies; two counts of attempted illegal use of a minor in nudity-oriented material, third-degree felonies; and two counts of attempted illegal use of a minor in nudity-oriented performance, first-degree misdemeanors.

If found guilty, he faces a maximum of 22 years in prison.

Dellifield resigned March 31, 2016. He had been with Allen East schools for 44 years.
