16-year-old indicted in murder case

LIMA — A 16-year-old police said killed another man was indicted by the grand jury this week on murder and felonious assault.

Albert McDowell III faces up to life in prison on the charges that also allege the crimes were committed using a firearm.

Prosecutors sought a mandatory bind over from juvenile court against McDowell so they could try him as an adult. If he was tried as a child, McDowell would face less than five years in prison, since he cannot be held past his 21st birthday. Ohio law allows him to be tried as an adult on the charges he was indicted.

McDowell is charged in the March 7 shooting death of Da’Veon Petaway, 19. Petaway was shot once in the abdomen at Meat City, 801 E. Kibby St., Lima. McDowell was on the run for nearly a month as he tried to stay away from police, but they were able to track him. With the help of state troopers, they captured McDowell at a rest area near Piqua as he made one last attempt to get away.

Lima Police Department investigators said they have “concrete evidence” linking McDowell to Petaway’s murder and said he was a “primary participant” in the shooting of Petaway’s brother, Kylil Florence, in January 2015.

Damere Crockett, 17, was convicted in Florence’s killing and sentenced to 12 years in prison, but investigators still believe McDowell had a role. McDowell has not been charged in the Florence killing.
