WAPAKONETA — A Feb. 8 trial date has been set for a lawsuit involving a company the Ohio Attorney General’s Office said released chemicals into the air, creating a health problem.
The attorney general filed the lawsuit against AIP Logistics, of Wapakoneta, accusing the company of allowing chemicals that can burn the skin and cause respiratory problems to be released into the air at least eight times in August, November and December. The release affected people living nearby the operation, according to the lawsuit.
AIP denies eight releases and said there only were two — Aug. 26 and Nov. 29.
The two sides are operating under an agreement that allows AIP to continue operating but under restrictions to prevent a chemical release.
The judge also scheduled a motion hearing Oct. 9 to determine whether the City of Wapakoneta can join the lawsuit as a party. The action was filed in Auglaize County Common Pleas Court.
