LIMA — A week after his bond was revoked for testing positive for marijuana use, a Spencerville man who accused police of beating him during an arrest will be released from jail.

Judge David Cheney reinstated bond and ordered Tyler Paxson to be released Thursday. Paxson must be tested for drugs in his system upon release and at other times.

Paxson is charged with one count of felonious assault, a fourth-degree felony, which carries a maximum penalty of 18 months in prison. His trial is scheduled for May 4.

Police said Paxson, who is 19, was highly intoxicated and posing a danger to himself and the community so he was arrested. An officer came across him while responding to an unrelated incident.
