Man files wrongful death lawsuit over mother’s death

LIMA — A family member of a Spencerville woman who died in 2013 is suing the medical providers, alleging the providers didn’t properly care for her mother.

Terry Kill filed the lawsuit this month on behalf of the estate of his mother, Helen Kill. Named as defendants are Dr. Pamela Gardner, the Heart Institute of Northwest Ohio and Lima Memorial Health System.

Kill is seeking more than $25,000 in damages.

A representative of Lima Memorial could not be reached for comment Friday.

Gardner is a cardiologist who treated Helen Kill in September and October 2013 while at the Heart Institute, which is owned by Lima Memorial Health System.

The lawsuit accuses the medical defendants of negligence in the care and treatment of Helen Kill leading to her untimely death.

Specifically, it says the defendants failed to appropriately monitor anticoagulant drug, a blood thinner, Dr. Gardner prescribed for Helen Kill, according to the lawsuit.

Helen Kill, 73, died from complications of bleeding into her brain. She experienced great pain and suffering as well as loss of enjoyment of life, mental anguish and death, according to the lawsuit.

Helen Kill died Oct. 3, 2013, according to the lawsuit.

Terry Kill also brought the action saying she suffered mental anguish and emotional distress from his mother’s death. He also had medical and funeral expenses, according to the lawsuit.
