Secretary of State officials: trying to resolve charter error

GOMER — A spokesman for the Ohio Secretary of State’s said officials at the office are working to try to resolve an error that put a local business in poor corporate standing with the agency.

“We are trying to get this matter resolved for him as quickly for him as we can,” said Matt McClellan, a spokesman for the Ohio Secretary of State.

The owner of Uncle’s Al’s Pizza, Alan Tyrrell, has been dealing with the matter for about six weeks after a routine check by his insurance company on his corporation’s status with the state agency showed a negative result. It resulted in Tyrrell having to pay a higher premium.

Tyrrell found out a company with the same name on the other side of the state that no longer exists hijacked his charter number in 1986. He was never made aware. That company lost its charter in 2007, which was Tyrrell’s original charter although no longer in his name.

Now Tyrrell is trying to get the matter resolved and has filed a lawsuit in Allen County Common Pleas Court. He wants his corporation’s status changed to a positive standing with the Secretary of State’s office, and he wants his legal fees paid.

McClellan said Husted was not Secretary of State when the error occurred but his office is committed to resolving it.
