LIMA — The family of a teenager killed in a motorcycle accident has filed a wrongful death lawsuit against the driver of the car involved in the crash.
The family of Clarence R. Robinson Jr. filed the lawsuit in Allen County Common Pleas Court seeking more than $25,000 in damages. David W. Martin, of Lima, was named as the driver of the car and the car’s owner, Rex Martin of Lima, were both named as defendants.
The crash happened May 15, 2013, in the 900 block of Faurot Street, near South Baxter Street. Martin was westbound on Faurot Street when he attempted to turn south into a driveway, police reported.
Martin’s car collided with Robinson’s motorcycle, which was eastbound on Faurot Street.
The lawsuit was filed by Thomas Kerrigan II, the administrator of the estate for Robinson. It was filed on behalf of the family.
The lawsuit alleges David Martin was negligently operating the vehicle when he turned in front of Robinson. He failed to yield the right of way and failed to look out for other vehicles, the lawsuit said.
Robinson suffered pain from his injuries and died. The family suffers from his loss and has funeral expenses of more than $8,000, the lawsuit said.
Robinson was engaged to Megan Copeland, who was pregnant with their child when Robinson was killed, the lawsuit said.
The lawsuit said Rex Martin was negligent in entrusting the use of his car to David Martin.
